These Terms of Service ("Terms") are an agreement between you and MechItAll LLC ("MechItAll," "we," "us"), the company that makes artograffi, an augmented-reality app for drawing in 3D space, tying that art to real places, and sharing it.
The app asks you to accept these Terms before you can use it. If you don't agree, don't use artograffi.
1. Agreement and related documents
When you tap to accept in the app, create an account, or otherwise use artograffi, you agree to these Terms. The following are part of these Terms by reference:
You must be at least 13 years old, or older if the law where you live sets a higher minimum age for using online services without parental consent (for example, up to 16 in some EU countries).
If you're under 18 (or the age of majority where you live), a parent or legal guardian must review and agree to these Terms for you.
You can't use artograffi if you've been banned from it before, or if the law prohibits you from using it.
If we learn that someone under 13 has an account, we'll delete it.
You can sign up with an email and password, a phone number, or a Google account. Give accurate information and keep it current.
You're responsible for everything that happens on your account and for keeping your password, PIN and devices secure. Tell us right away at contact@mechitall.com if you think someone else is using your account.
An account is for one person. If you link several accounts for quick switching on one device, each one is still subject to these Terms.
Ghostograffer mode lets you post under an alias. An alias may not be used to impersonate a real person, brand or organization, to mislead people about who you are in a harmful way, or to get around a block, restriction or ban.
Usernames that impersonate others, infringe trademarks or break the Community Guidelines may be changed or reclaimed.
You own what you create and upload: drawings, meshtograffs, photos, videos, audio, captions, comments, messages and other material ("your content").
To run the service, you give MechItAll a worldwide, non-exclusive, royalty-free license to host, store, copy, process, adapt (for example resize, compress, transcode, generate thumbnails and previews, or translate on request), display and transmit your content, only as needed to operate, secure, moderate and improve artograffi and to show your content to the people you choose. This includes analyzing content with automated tools for safety (see section 7).
This license ends when you delete the content or your account, except: (a) copies other people already received, such as messages you sent or pieces you shared to someone; (b) content we must keep for legal, safety or fraud-prevention reasons, as described in the Privacy Policy; and (c) residual copies in routine processing that are deleted on their normal schedule.
You confirm you have the rights needed to post your content and that it doesn't break these Terms or the law. If you send us feedback or ideas, we may use them without any obligation to you.
Pieces you save are tagged to the real-world place where you saved them (or the place you choose for an event). Nearby content is shown based on that location.
You choose who can see each piece: only you, specific people, close artograffers, artograffers, or everyone nearby. You can also share pieces to the public Feed or send them to a friend. You can change most of these settings later.
Some features create public web pages, for example the page a QR code opens for a profile or a piece. Anything you make visible to others can be screenshotted, recorded or re-shared by them; we can't control that.
Don't tag content to a place in a way that reveals someone else's home or private information. See the Safety page for how to protect your own location.
Post or share anything that sexualizes, exploits or endangers minors. This is never allowed. We remove it, terminate the account, and report it to the National Center for Missing & Exploited Children (NCMEC) and other authorities as required by law.
Post sexually explicit content, or graphic violence or gore.
Harass, bully, threaten, stalk or dox anyone, or post hate speech.
Post content that is illegal, promotes violence or self-harm, or facilitates crime, including the sale of illegal or regulated goods.
Infringe anyone's copyright, trademark, privacy or other rights.
Spam, run scams, impersonate others, or fake engagement.
Access other accounts or data without permission; scrape, crawl or bulk-collect data; spoof your location to reach content you otherwise couldn't; get around visibility, access-window, location-lock, unlock or moderation features; or bypass app integrity checks.
Disrupt, overload or attack the service, or reverse-engineer it except as the law expressly allows.
To keep artograffi safe, we use automated tools in addition to user reports and human review:
Images and videos you save are checked with Google Cloud's content-safety services. If something is likely adult or violent content, it's automatically hidden from everyone except you while an administrator reviews it. You'll see a notice on the piece.
Critiques (comments) are checked with Google Cloud's text-moderation service. Severely toxic or threatening comments may be removed automatically.
An administrator reviews flagged material and either restores it or removes it.
Automated tools make mistakes in both directions. If you believe something was hidden or removed in error, email contact@mechitall.com with a link or description and we'll take another look. We aren't obliged to monitor everything, and we don't guarantee that all objectionable content will be caught.
You can report a piece, a message or a user from inside the app, and you can block or mute anyone. We review reports and may remove content, limit features, or suspend or terminate accounts that break these Terms. Reports alone never remove content automatically; a person reviews them.
Depending on how serious a violation is, we may act without warning. Where it's practical and lawful, we'll tell you what we did and why. To appeal a decision, email contact@mechitall.com within 30 days and explain why you think we got it wrong. A different reviewer will look at it when possible.
If you believe content on artograffi infringes your copyright, send a notice to contact@mechitall.com that includes:
your physical or electronic signature;
the copyrighted work you claim is infringed;
the content you want removed, with enough detail for us to find it (for example, a link or the creator's username and the piece's title);
your contact information;
a statement that you believe in good faith the use isn't authorized by the owner, its agent or the law; and
a statement, under penalty of perjury, that your notice is accurate and that you're the owner or authorized to act for the owner.
If your content was removed and you believe that was a mistake, you can send a counter-notice to the same address. We terminate the accounts of repeat infringers where appropriate.
Message translation runs on your device; comment translation uses Google Cloud Translation when you tap Translate. Machine translation can be wrong or miss context. Don't rely on it for anything important.
Maps and place names come from OpenStreetMap contributors and may be incomplete or inaccurate.
Sign-in, storage, notifications and other features rely on Google services. Your use of Google Play and your Google account is also governed by Google's own terms.
Links to other websites aren't under our control and we're not responsible for them.
Community events, vault items and live sessions are created by users, not by MechItAll. We don't organize, verify, supervise or endorse them, and we're not responsible for what happens at them. Use your own judgment before going anywhere or meeting anyone you met through artograffi, and follow the Safety page. Event organizers are responsible for their events being lawful and for having any permissions they need.
Drawing in AR means looking at your screen while you move. Stay aware of your surroundings: traffic, stairs, edges, obstacles and other people. Never use artograffi while driving or operating anything dangerous. Don't go onto private property without permission or anywhere unsafe to reach a piece or an event. Stop if you feel dizzy, uncomfortable or unwell. You use AR features at your own risk.
artograffi is currently free and has no ads. If we ever offer paid features, we'll show the price and any extra terms before you pay.
Some features unlock gradually over your first days. Features, limits and availability may change, and we may add, change or remove features at any time.
AR anchoring, cloud anchors, location accuracy and hand tracking depend on your device, sensors and surroundings, and won't always be precise.
You need a compatible device, a connection for most features, and you're responsible for any data charges.
The artograffi app, name, logo, design and software belong to MechItAll LLC and are protected by law. We give you a personal, non-exclusive, non-transferable, revocable license to use the app for its intended purpose under these Terms. You may not copy, sell or modify the app or use our branding without our written permission.
You can stop using artograffi at any time and delete your account in the app under Settings → Delete account, or through the account deletion page. We may suspend or terminate your access if you break these Terms, if we're required to by law, or if your use creates risk or legal exposure for others or for us. Sections that by their nature should survive termination (such as content licenses for already-shared copies, disclaimers, limitation of liability, indemnity and governing law) continue to apply.
To the extent the law allows, artograffi is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We don't promise the app will be uninterrupted, secure or error-free, that content will never be lost, or that content from other users is accurate, safe or lawful. Other users are responsible for what they post and do.
To the fullest extent the law allows, MechItAll LLC and its owners, employees and contractors are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill, arising from your use of artograffi, from content or conduct of other users, or from visiting any place or attending any event referenced in the app. Our total liability for any claim relating to artograffi is limited to the greater of the amount you paid us in the 12 months before the claim or USD $50.
Nothing in these Terms limits liability that can't be limited by law, including for death or personal injury caused by our negligence, fraud, or gross negligence or willful misconduct, or any rights you have as a consumer under mandatory law.
To the extent the law allows, you agree to defend and compensate MechItAll for claims, losses and costs (including reasonable legal fees) brought by third parties that arise from your content, your breach of these Terms, or your violation of anyone's rights. This doesn't apply to the extent a claim was caused by our own fault, or where your local consumer law doesn't permit it.
We may update these Terms. For material changes, we'll update the "Last updated" date and ask you to review and accept the new version in the app before continuing. If you don't accept, you can stop using artograffi and delete your account. Minor changes (for example, wording or formatting) take effect when posted.
These Terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Florida, and you and we consent to their jurisdiction.
If you live in the European Union, the United Kingdom or another country with mandatory consumer protections, you keep the protection of those laws and may bring a claim in the courts of your home country. Before filing a claim, please contact us at contact@mechitall.com so we can try to resolve it informally.
These Terms, together with the documents they reference, are the entire agreement between you and us about artograffi.
If any part is found unenforceable, the rest stays in effect.
If we don't enforce a provision right away, we don't waive our right to do so later.
You can't transfer your rights under these Terms. We may transfer ours, for example in a merger or sale of the business, with notice to you.
These Terms are available in English, Spanish and German. If versions conflict, the English version controls, unless your local law requires otherwise.
